The directive sets out rules for collection, treatment, recycling and disposal of batteries, and aims to prohibit certain hazardous substances and to improve environmental performance of batteries and all operators in the supply chain.
Prohibitions
Batteries or accumulators including those incorporated into appliances shall be prohibited if they contain:
- Mercury higher than 0.0005% max by weight except for button cells which is limited to 2%;
- Cadmium higher than 0.002% max by weight.
Labelling
1. All batteries, accumulators and battery packs should be appropriately marked with the crossed-out wheeled bin;
2. The capacity of all portable and automotive batteries and accumulators should be indicated on them by 26 September 2009;
3. Batteries, accumulators and button cells that exceed the stated limits for mercury and cadmium or that contain more than 0.004% lead must carry the crossed-out wheeled bin symbol together with the relevant chemical symbol for the metal concerned (Hg, Cd or Pb). The symbol indicating the heavy metal shall be printed beneath the wheeled bin and shall cover an area of at least 1/4 the size of that symbol;
4. The crossed-out wheeled bin symbol shall cover at least 3% of the area of the largest side of battery, accumulator or battery pack, up to a maximum size of 5 x 5 cm. In the case of cylindrical cells, the symbol shall cover at least 1.5% of the surface area of the battery or accumulator and shall have a maximum size of 5 x 5 cm;
5. Where the size of the battery, accumulator or battery pack is such that the symbol would be smaller than 0.5 x 0.5 cm, the battery, accumulator or battery pack need not be marked but a symbol of at least 1 x 1 cm shall be printed on the packaging,
6. All symbols shall be printed in a visibly, legibly and indelibly form.
Disposal instructions must accompany each battery. It may be shown on packaging or on instruction sheets where batteries are supplied with the toy or imported. Example of appropriate instruction is shown for reference. .
However it must cover the following points: .
a. the potential effects on the environment and to human health of the substances; b. not to dispose of in domestic waste; c. collection and recycling scheme details; d. the consumer role in contributing to the recycling; e. the meaning of the crossed-out wheeled bin symbol and the chemical symbols Hg, Cd and Pb.
Removal of Waste Batteries
Appliances should be designed in such a way that waste batteries can be readily removed. In case the batteries are incorporated into the appliances, instructions for safe removal of batteries must be included within the product instructions. Exemptions to this apply to products where the continuity of power supply must be maintained for safety reasons.
Recycling Batteries .
Member States shall achieve the take back and recycling targets:
- minimum 25% by 26 September 2012;
- minimum 45% by 26 September 2016.
Industrial batteries require 100% take back and no disposal in landfill or by incineration will be permitted

New EU Directive on Battery and Accumulator
A new battery directive 2006/66/EC on Battery and Accumulator replacing directive 91/157/EEC shall be effective on the 26th September 2008. Toys packed with batteries and placed on the EU market after this date shall be affected as the directive applies to all types of batteries and accumulators (AA, AAA, button cells, lead acid, rechargeable packs) including those incorporated into appliances except for military, medical and power tool applications.The directive sets out rules for collection, treatment, recycling and disposal of batteries, and aims to prohibit certain hazardous substances and to improve environmental performance of batteries and all operators in the supply chain.
